摘要:
 

救助站在对流浪人员的管理、救助中起到了不可或缺的作用, 但在“救助站为流浪者索赔”的民事诉讼

中, 救助站作为当事人是否适格存在诸多争议。救助站具备民事诉讼主体资格, 其作为原告为流浪者这

一弱势群体的利益进行诉讼, 符合国家、社会、个人的正义观念, 且顺应法律法规的立法原意, 其实施

司法救济, 具有必要性与正当性。

Abstract:
 The relief station plays an indispensable role in the management and rescue of the homeless

people. However, in the civil lawsuit of“relief station claiming for compensation for

homeless people”, there are disputes about whether the relief station is suitable to act

as a litigant. The relief station has the subject qualification of civil lawsuit, and it

acts as a plaintiff for the interests of vulnerable homeless group, which conforms to

national, social and individual concept of justice, as well as complies with the

legislative intent of laws and regulations.It is necessary and legitimate to implement

judicial relief.
